The General Conditions of Contract regulate the distance selling relationship between GRUPO BURK SL and the user or customer, in accordance with the legal stipulations, in particular, Law 7/1998, of April 13, on General Conditions of Contract, Law 3/2014, of March 27, which amends the revised text of the General Law for the Defense of Consumers and Users, Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights, General Data Protection Regulation (EU) 2016/679, Law 7/1996, of January 15, on the Regulation of Retail Trade, and Law 34/2002 of July 11, on Information Society Services and Electronic Commerce.

Order execution

GRUPO BURK SL undertakes to deliver the order within the following period: the sale of sports equipment.

The availability of the products offered by GRUPO BURK SL may vary depending on customer demand. Although GRUPO BURK SL updates the stock periodically, the product requested by the customer may be out of stock at that time.

In case of non-execution due to unavailability, GRUPO BURK SL will proceed as follows: the customer will be contacted to inform the new delivery time. This does not apply in discount periods, in which case the order will be automatically cancelled.

Right of withdrawal

The buyer has fifteen calendar days to cancel the purchase, starting from the day the customer receives the product, without any penalty and without having to provide a reason. The product must be returned showing no signs of use, in perfect condition, clean, and in its original packaging, including labels and accessories, just as it was received.

The customer must return the products subject to the right of withdrawal without undue delay and, in any event, no later than 15 calendar days from the date on which the decision to withdraw is communicated.

The refund for the cancellation will be issued within 15 calendar days from the date on which the decision to cancel the contract was effectively and unequivocally communicated, provided that the goods or products subject to the cancellation have been received beforehand or until the consumer and user has provided proof of the return of the goods, whichever condition is met first. Otherwise, the refund may be withheld until such goods are received or until the Customer provides proof of the return of the goods.

The user is informed that he shall only be liable for any diminished value of the goods resulting from the handling of the goods other than what is necessary to establish their nature, characteristics or functioning.

According to the provisions of Article 103 of Law 3/2014, of March 27, which amends the revised text of the General Law for the Defense of Consumers and Users, supplies of services or goods made according to consumer specifications or clearly personalized, or which, by their nature, cannot be returned or may deteriorate or expire rapidly, are exempt from withdrawal. The product being one of the following exceptions:

The return

The customer must return or deliver the product directly to GRUPO BURK SL, to the address CALLE CATALUÑA 21, 28350 CIEMPOZUELOS (MADRID), without any undue delay, and in any case within a maximum period of fourteen calendar days from the date on which the right of withdrawal of the contract is formalized. It will be understood that the deadline has been met if the customer returns the product before the end of the period.

The customer shall bear the cost of returning the product. Refund of payment

The reimbursement of the amounts paid by the customer will be made using the same means of payment used by the customer, unless otherwise provided.

GRUPO BURK SL will refund the amounts paid by the customer within 15 calendar days of receiving notice of the right of withdrawal.

Except where the entity has offered to collect the goods itself, in sales contracts, the entity may withhold reimbursement until it has received the goods, or until the consumer and user has provided proof of the return of the goods, whichever condition is met first.

Return of defective product

In the event that the product is not in good condition and the causes attributable to this, are not the result of the customer, the customer will be entitled to return the product, informing GRUPO BURK SL of the reason for return through any of the means provided in these conditions of contracting, and at no cost to the customer. This return due to defect or poor condition of the product will not be considered a right of withdrawal. In this case, the product must be returned without signs of use, in perfect condition, clean and with its original packaging, including labels and accessories, as received.

GRUPO BURK SL undertakes to assume the cost of the return and to return the product for a new one in accordance with the conditions accepted at the time of sale.

Jurisdiction

The relationship between the user and the provider shall be governed by the regulations in force and applicable in the Spanish territory. If any dispute arises, the parties may submit their disputes to arbitration or go to the ordinary jurisdiction in compliance with the rules on jurisdiction and competence in this regard.
